GENERAL TERMS AND CONDITIONS – PRIVACY AND RENTAL AGREEMENT

1. Registration of the Tenant with the Landlord and acceptance of the Tenancy Agreement


Please send us your personal details (for each guest) before arrival (check-in), which are only required for the registration of your stay with the local authorities and the management of the tenancy agreement:

First name – Surname – Date and place of birth – Gender – Number and place of issue of a valid ID or passport.

Only registered guests can access our properties!

The main guest making the booking must be of legal age and accept the general terms and conditions at the time of booking. They also accept the short-term rental agreement at the bottom of this page (point 7) and are considered “the Tenant” in the rental agreement.

The Tenant enters into a “short-term rental” agreement with the Landlord.

The Landlord ‘Host’ is the owner of the accommodation, the website www.tradizionecasa.com and the telephone numbers listed on the website.

The tenant has the permits and regulations relating to short-term rentals in each state/country of the relevant accommodation (the relevant official authorisation code, where necessary and required by local regulations, is shown on the relevant page for each accommodation on the website www.tradizionecasa.com).

2. General accommodation rules for tenants


Smoking is prohibited in all our properties. Smoke detectors, CO detectors and fire extinguishers are present in all our properties (CO detectors where necessary).

Our properties are equipped with all the accessories required for your stay, as required by local regulations.

The main guest (tenant) will receive the keys to the house or flat for the entire stay and, in some cases, an access code for the main door, which must be kept safe and secret.

Check-in can take place after 4 p.m. on the day of arrival (5 p.m. for the TGA Franzestg accommodation in Riom, Switzerland).

Check-out on the day of departure must take place by 10 a.m. unless otherwise specified (11 a.m. for TGA Franzestg accommodation in Riom, Switzerland, and Casa Zurenborg accommodation in Berchem, Belgium).

Before departure, the tenant must comply with the following conditions:

_Collect all waste separately and place it in the internal compartments or external areas indicated by the Landlord during the check-in information phase relating to the accommodation.

_Make the beds and leave used sheets and towels in the place specified during check-in

_Empty and clean the refrigerator and freezer.

_Clean all dishes and the kitchen area, including the oven and microwave.

_Close all windows, doors and skylights.

_Switch off all lights and, where applicable, the air conditioner

_Clean the ashes from the fireplace if used

3. Rental price and payment method


The rental price is for the entire duration of your stay.

The cost of electricity, hot water, gas, heating and Wi-Fi are included in the price, as is a set of bed linen and towels for each guest, which are provided by us.

With ‘Book Now’, your booking is confirmed for 48 hours. You will receive an email with information about your selected payment method:

If you have opted to pay by credit card/PayPal, you will be redirected to the dedicated website for payment and will receive immediate booking confirmation.

If you have opted to pay by bank transfer, you will receive an email with the details for the transfer to be made within 48 hours.

For bookings with a check-in date more than 7 days away, a deposit of 30% of the total rate is required.

For bookings with a check-in date less than 7 days away, the total rate is required.

4. Cancellation and early departure


For cancellations up to 7 days before check-in, you can request a voucher code for the value of the deposit, valid for 1 year, for a new booking at one of our properties.

In the event of cancellations up to 30 days before check-in, you can request a full refund (net of PayPal transaction costs) or a coupon code for the value of the deposit, valid for 1 year, for a new booking at one of our properties.

If the guest does not show up or decides to end their stay early, they are not entitled to any refund.

5. Responsibilities of the main guest ‘Tenant’ during the stay


The rented property, including the furniture and all accessories present in the property, must be used and treated with care. The main guest is responsible for his/her actions and those of the persons registered by him/her upon arrival, which may compromise the property and its contents.

The main guest is responsible for any damage caused by him to the property or any contents, whether caused directly or by another registered guest. Only guests declared at the time of booking and registered may access the accommodation.

Any damage found during check-in or caused during the stay must be reported to the owner immediately.

Pets are only accepted in certain properties, but always subject to prior authorisation from the owner.

6. Data processing and privacy


Personal data entered in the forms on the website and sent by email or message to the landlord will only be used for official communications between the landlord and tenant and will not be retained at the end of the stay.

This website www.tradizionecasa.com does not use cookies.

7. LEASE AGREEMENT


LEASE AGREEMENT ‘short-term rental of less than 30 consecutive days, for tourist purposes’

For Italy: (pursuant to Article 1, paragraph 2, letter c) of Law No. 431/1998 and Article 4 of Decree Law No. 50/2017)

DATE: The date of registration of the contract is equivalent to the date shown on the booking confirmation received by the tenant, through the Landlord’s contacts, in paper form, by email or other electronic means, at the addresses provided by the tenant.

BETWEEN

Mr Paolo Giuriani, resident at Transvaalstraat 65, 2600 Berchem, Belgium, Italian Tax Code GRNPLA79P30C623A – Belgian VAT No. BE0665689026, hereinafter referred to as the ‘LANDLORD’

AND

the main guest, hereinafter referred to as the ‘TENANT’, who has provided their personal details via the registration and booking form on the website www.tradizionecasa.com or by email to the Landlord, who collects the data for the purposes of registering this contract;

the following is agreed and stipulated:

7.1 Subject of the lease

The Lanlord leases to the Tenant, who accepts, the property (the accommodation selected by the Tenant at the time of booking) for the purpose of satisfying exclusively tourist accommodation needs. The Tenant declares that they will not use the property for work or study purposes and declares that they will spend a short holiday there.

The undersigned landlord, GIURIANI PAOLO, owner of the property located in the municipality, address and country specified on the accommodation page, consisting of the property and its furnishings (furniture, crockery, etc.), as described and specified in the relevant information sheet for the accommodation selected by the Tenant at the time of booking:
the owner of the property declares that it complies with the current state of the property itself and with the relevant regulations in force in terms of tourist rentals.

7.2 Duration

The lease shall have a duration of days, with the start date and time (check-in) and end date and time (check-out) as specified in the online booking form, previously completed by the tenant and confirmed by the landlord via a specific online confirmation.

Upon expiry, the contract shall terminate without the need for notice of termination, which is hereby deemed to have been given and accepted.

7.3 Intended use


The property shall be used exclusively for residential purposes for the Tenant’s holiday and by the number of persons accompanying them as declared at the time of booking and registration.
The Tenant undertakes not to use the property for purposes other than those agreed, not to sublet the property, even partially, not to transfer the contract and not to allow other occupants to stay there other than those indicated at the time of booking and registration.

Guests are registered by the Tenant providing the Landlord with their identification details, including their first name, surname, date of birth, nationality and place of residence.

The Tenant must also provide the number and type of a valid identity document (passport or identity card) which may be inspected by the Landlord.

7.4 Rental fee


The rental fee for the entire period is equal to the amount established at the time of booking and reported in the booking confirmation and in communications between the parties, which the Tenant undertakes to pay to the Landlord as follows:

30% as a deposit at the time of booking;
70% balance within 7 days before the start of the rental.
Payment must be made by: □ bank transfer to the IBAN account specified by the Landlord, or in cash (within the limits permitted by law), or by electronic payment (credit card/PayPal).

7.5 Security deposit, liability commitment

The Landlord does not require a security deposit to guarantee the obligations assumed under this contract, but the Tenant undertakes to promptly report any damage caused to the property and its contents, agreeing with the Landlord on any compensation, subject to verification of the condition of the property and furnishings upon arrival.

7.6 Delivery and return of the property


The Tenant declares that they have visited the property and found it to be in good condition, suitable for the agreed use and equipped with all the system certifications required by current legislation.

At the end of the contract, the Tenant undertakes to return the property in the same condition in which they received it, except for normal wear and tear, under penalty of compensation for damages.

7.7 Additional charges


The Landlord shall bear the costs relating to: □ electricity supply □ water supply □ gas supply □ heating □ air conditioning where available □ internet connection where available □ final cleaning (except kitchen area and crockery) □ 1 set of bed linen and towels per guest per stay.

All other expenses not previously mentioned shall be borne by the Tenant.

7.8 Obligations of the Tenant


The Tenant undertakes to:

use the property with due diligence;
comply with the condominium regulations and the laws relating to peaceful coexistence;
not disturb the peace of other condominium residents;
promptly report any damage or faults to the Landlord;
not make any changes, innovations or improvements to the property without the prior written consent of the Landlord;
respect the maximum number of people who can stay in the property, as indicated in Article 3;
respect the ban on smoking inside the property (if applicable);
respect the ban on bringing animals into the property (if applicable);
separate waste for recycling in accordance with municipal regulations.

7.9 Obligations of the Landlord


The Landlord undertakes to:

guarantee the peaceful enjoyment of the property for the entire duration of the lease;
deliver the property in a good state of repair and cleanliness;
carry out urgent repairs, except for minor maintenance, which is the responsibility of the Tenant;provide the property with all the services indicated in the description and in the agreements prior to booking.

7.10 Prohibition of innovations


The Tenant may not make any changes, innovations, improvements or additions to the leased property and its intended use, or to the existing systems, without the prior written consent of the Landlord.

7.11 Exemption from liability


The Landlord shall be exempt from liability in the event of interruption of services for reasons beyond his control. The Landlord shall not be liable for theft or damage to the Tenant’s property in the property.

7.12 Early termination


In the event of early termination by the Tenant:

if notified at least 30 days prior to the start date of the stay, the 30% deposit paid will not be retained, except for transaction costs via electronic payment or bank charges.
if notified between 29 and 7 days before the start of the stay, 30% of the total amount will be retained;
if notified less than 7 days before the start of the stay or in case of no-show, 100% of the total amount will be retained.

7.13 Termination of the contract


Failure to comply with even one of the Tenant’s obligations under the contract shall result in the termination of the contract by operation of law, in Italy pursuant to Article 1456 of the Civil Code, in addition to compensation for damages.

7.14 Notification to the police headquarters and public tourism institutions where required

The Landlord shall notify the police headquarters and public tourism institutions of the presence of guests, in accordance with current regulations on public safety and the reporting of tourist flows.

7.15 Amendments to the contract


Any amendment to this contract shall be valid only if made in writing.

7.16 Domicile


For all purposes of this contract, including the notification of enforcement measures, and for all disputes that may arise, the Tenant elects domicile in the property subject to the lease and, if he does not occupy or otherwise hold it, at the Secretariat Office of the Municipality where the leased property is located. The Landlord elects domicile at his/her residence/registered office.

7.17 Mediation and jurisdiction


Any dispute arising from the interpretation, execution or termination of this contract shall be referred to a mediation body. Any dispute arising from the interpretation, execution or termination of this contract shall be referred to the court with jurisdiction over the location of the leased property.

7.18 Reference


For anything not expressly provided for in this contract, the parties expressly refer to the provisions of the Civil Code and the regulations in force in the state/country where the leased property is located, as well as to local customs and regulations in force regarding short-term leases for tourist purposes.

7.19 Registration


This contract is subject to registration in Italy only in the event of use pursuant to Article 1, paragraph 346, of Law No. 311/2004. In this case, the registration costs shall be borne by the party requesting its use.

7.20 Privacy


The Landlord and the Tenant mutually authorise each other to process personal data in accordance with EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003 and subsequent amendments, exclusively for purposes related to the execution of this contract.
